Event Terms and Conditions

Cancellation Policy

Registration cancellations are available up to 60 days prior to the start of the conference. Within 60 days of the conference, you may transfer your registration to a future conference (must be used within 1 year). Refunds or transfers are not available within 1 week of the conference. $100 of the course registration is nonrefundable in the event of a cancellation. If you fail to attend after the start of the conference, you will forfeit the registration cost. You must request a cancellation in writing to info@travelingvetretreats.com.  

RELEASE OF LIABILITY AND ASSUMPTION OF RISK The individual named below (referred to as “I” or “me”) desires to participate in the conference event Traveling Vet Retreats (the “Activity”) provided by Traveling Vet Retreats, LLC based in Texas (“TVR”).  In consideration of being permitted by TVR to engage in the Activity and the intangible value that I will gain by participating in the Activity, and in recognition of the TVR’s reliance hereon, I agree to all the terms and conditions set forth in this agreement (this “Release”). 1. I am aware and understand that the Activity is a potentially dangerous activity and involves the risk of serious injury, disability, death, and/or property damage. I am also aware of the highly contagious nature of viral diseases, including the 2019 novel coronavirus disease (COVID-19) (collectively, the “Disease”) and the risk that I may be exposed to or contract the Disease by engaging in the Activity, which may result in serious illness, personal injury, disability, death, and/or property damage. I acknowledge that these risks may result from or be compounded by the actions, omissions, or negligence of TVR employees or others, including negligent emergency response or rescue operations of TVR. I understand that while the TVR has implemented measures to reduce the risk of injury from the Activity and the spread of the Disease, TVR cannot guarantee that I will not be injured or become infected with the Disease due to my participation in the Activity and that engaging in the Activity may increase my risk of contracting the Disease. NOTWITHSTANDING THESE RISKS, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY WITH KNOWLEDGE OF THE DANGERS INVOLVED. I HEREBY AGREE TO ACCEPT AND ASSUME ALL RISKS OF INJURY, ILLNESS, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF TVR OR OTHERWISE. 2. I hereby expressly waive and release any and all claims, now known or hereafter known, against TVR, and its officers, directors, employees, agents, affiliates, members, successors, and assigns (collectively, “Releasees”), on account of injury, illness, disability, death, or property damage arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of TVR or any Releasees or otherwise. I covenant not to make or bring any such claim against the Association or any other Releasee, and forever release and discharge TVR and all other Releasees from liability under such claims. This waiver and release does not extend to claims for gross negligence, willful misconduct, or any other liabilities that Texas law does not permit to be released by agreement. 3. I confirm that I am: (a) in good health, in proper physical condition, and do not have any medical or other conditions that would impair my ability to participate in the Activity; and (b) not experiencing symptoms of the Disease (such as cough, shortness of breath, or fever), do not have a confirmed or suspected case of the Disease, and have not come in contact in the last 14 days with a person who has been confirmed to have or suspected of having the Disease. I will comply with all federal, state, and local laws, orders, directives, and guidelines related to the Activity and the Disease while participating in the Activity, including, without limitation, quarantine or self-isolation periods, requirements related to hand sanitation, social distancing, and use of face coverings and safety equipment. I will also follow all instructions, recommendations, and cautions of TVR at all times during the Activity. If at any time I believe conditions to be unsafe, that I am no longer in proper physical condition to participate in the Activity, or I begin experiencing symptoms of the Disease, I will immediately discontinue further participation in the Activity and/or not attend the Activity. 2 4. I shall defend, indemnify, and hold harmless TVR and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by or awarded against TVR or any other Releasees, arising out or resulting from any claim of a third party related to my participation in the Activity, including any claim related to my own negligence or the ordinary negligence of TVR. 5. I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Activity. I understand and agree that I am solely responsible for all costs related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless TVR from any claim based on such treatment or other medical services. 6. This Release constitutes the sole and entire agreement of TVR and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of TVR and me and our respective successors and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to any choice or conflict of law provision or rule (whether of the State of Texas or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Travis County, Texas, and I hereby consent to the exclusive jurisdiction of such courts. BY AGREEING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE TVR. 

WAIVER AND RELEASE OF CLAIMS PLEASE READ CAREFULLY – THIS IS A RELEASE OF LIABILITY AND A WAIVER OF CERTAIN LEGAL RIGHTS  

By registering for and attending Traveling Vet Retreats (TVR), you, on behalf of yourself and your Guests (including, without limitation, family members) (“Guests”), assume all risks associated with your attendance and participation in all on- and off-site activities that are part of or affiliated with the Traveling Vet Retreats. By registering for this meeting, you, on behalf of yourself and your Guests, agree to indemnify, defend, and hold harmless TVR, its officers, directors, employees, and agents from all allegations, claims, actions, losses, damages, costs, expenses (including reasonable attorney’s fees) or liability of any kind arising out of or related to attendance and participation at the TVR Conference by you and your Guests, including without limitation, personal injury (including death) or any damage caused by you or any of your Guests to any venue utilized by TVR for the conference or your failure to comply with applicable law or the rules and regulations of the venue. TO THE FULLEST EXTENT PERMITTED BY LAW, I, ON BEHALF OF MYSELF AND MY GUESTS, DO HEREBY RELEASE, ACQUIT AND FOREVER DISCHARGE Traveling Vet Retreats, ITS OFFICERS, DIRECTORS, EMPLOYEES, INSURERS AND AGENTS OF AND FROM ANY AND ALL, AND ALL MANNER OF CHARGES, CLAIMS, ACTIONS, RIGHTS, DEMANDS, DEBTS, LIABILITY, ACTIONS, CLAIMS FOR ATTORNEYS’ FEES, DAMAGES OF ANY KIND AND NATURE WHATSOEVER, IN LAW OR EQUITY, INCLUDING BUT NOT LIMITED TO CLAIMS FOR RIGHTS RELATED TO PRIVACY OR MISAPPROPRIATION OF IMAGE OR LIKENESS, PROPERTY DAMAGE AND/OR BODILY INJURY, EVEN IF CAUSED BY NEGLIGENCE OR GROSS NEGLIGENCE, ARISING OUT OF THE ACTS OR OMISSIONS OF TRAVELING VET RETREATS, ITS AGENTS, OFFICERS, SPONSORS, CONTRACTORS OR EMPLOYEES THAT MAY ARISE OR OCCUR IN CONNECTION WITH OR AS A RESULT OF ATTENDING THE TVR CONFERENCE.  

Photography and Recordings  

To comply with applicable data privacy laws, TVR imposes certain restrictions on the use of multimedia at its events, such as photography, video, audio, online streaming, and other media. Photography by attendees during any portion of a session is allowable at the discretion of the session speaker(s). In all cases, all photographs should be used for personal, non-commercial use and are not to be used for publication or rebroadcast without the express written permission of the speaker. Attendees who disturb a session (e.g. use flash photography, stand in front of other attendees to take photos) may be asked to leave the session. Unless noted otherwise, photography is allowed in the conference common areas and venues. Photography can be shared on social media in accordance to the conference’s social media policy. Both audio and video recording of sessions is strictly prohibited.  

Photograph and Video Recording Release 

TVR may take photos, videos, or make other recordings of attendees at conference events, or of people participating in functions or activities related to the Conference, including without limitation, images and recordings of participants in online or electronic meetings or events held in an electronic or virtual format (“Recordings”). Your attendance at Conference constitutes your agreement that TVR may make and use the Recordings in the future for any purpose, including without limitation, commercial, marketing, publicity, promotions, advertising, educational or other purposes. By registering for the Conference, you, on behalf of yourself and your Guests, expressly consent and agree to allow TVR to make and use the Recordings, which may include you, your family members or other Guests (including individuals under the age of 18), in all media formats worldwide for whatever purposes TVR deems appropriate. You acknowledge and agree that TVR shall own all intellectual property rights arising in connection with the Recordings, and that neither yourself nor your Guests shall receive (or be entitled to receive) any royalties or other compensation from TVR for any use of the Recordings.  

Personal Data Collection and Use  

As part of the registration process, TVR collects and uses information about you in connection with the provision of Conference services and for account administration, including: name, email address, street address, and registration type. By registering for and attending the TVR Conference, you expressly consent to the collection of this information and TVR’s use of this information for CE tracking purposes. By registering for or attending an TVR event, you agree not to share your event access information with anyone or to allow anyone to use your access information. Sharing your access information or allowing others to use your information may result in a revocation of your access credentials with or without a refund, in TVR’s sole discretion. TVR is committed to data privacy and protecting your personal information. Information on how TVR collects, processes, and uses your data is included in the TVR Privacy Policy which is hereby incorporated into these Terms & Conditions. Additionally, by submitting your email address during the event registration process, you agree that TVR may send you event-related information regarding your attendance and participation. TVR will not disclose your information to any third party services. Information you provide when registering for or participating in an event managed or co-sponsored by parties other than or in addition to TVR may be shared with those parties, and the treatment of such information is further subject to the privacy policies of those parties. Except as described herein, TVR will not disclose your personal data to any other third party without your consent except where required to do so by law. Because of the nature of TVR’s business, Conference services and benefits are not designed to appeal to minors. TVR does not knowingly attempt to solicit or receive any information from children. Safety Measures If required by governmental authorities, I agree to provide documentation or attestation to TVR in a form provided by or acceptable to TVR confirming a negative test result for COVID19 in the time immediately preceding my attendance at the Event. In addition, I agree to comply with all safety precautions required of Event attendees to help prevent the spread of COVID-19 or other contagious disease, such as wearing a face covering, staying physically distant from others, frequently washing hands, using hand sanitizer, and similar measures.  

Harassment Policy  

The TVR Conference is dedicated to providing a harassment-free conference experience for everyone, regardless of race, color, religion, national origin, sex, marital status, gender identity and expression, sexual orientation, disability, physical appearance, age, veteran status or any other status that may be protected by federal, state or local law. TVR prohibits harassment and discrimination of conference participants in any form. Conference participants and/or their Guests violating this policy will be expelled from the conference at the discretion of the TVR without any right to a refund. TVR reserves the right to change, amend, add or remove any of the above terms & conditions in its sole discretion and without prior notice. If one or more of the conditions outlined in these terms & conditions should become invalid, the remaining conditions will continue to be valid and apply. By registering for the Event, you agree that you have read this Waiver and Release of Claims in its entirety, fully understand its terms, and have agreed to its terms freely and voluntarily without any inducement, assurance, or guarantee being made to me. You intend for your Event registration to be a complete and unconditional release of liability to the greatest extent allowed by law for all persons I have registered, including my minor child(ren).
